It is important to note that certain products and services offered on our Site may be subject to additional terms and conditions (such as our Treats loyalty program or Auto ship subscription program), which will also apply to you. In the event of any inconsistency between these Terms of Use and any other applicable terms, the latter shall prevail. These Terms and Conditions, along with any other product or service-specific terms posted on our Site, constitute your service agreement (“Agreement”) with PetSmart, Inc. and any of its owned or operated sites where these Terms of Use are posted (“Pet Door USA”).
This Agreement outlines the legally binding terms and conditions governing your use of our Site and your purchase or use of any products or services offered on the Site. By accessing and/or using the Site, you represent and warrant that you have the legal capacity, authority, and right to enter into this Agreement and to comply with all of its terms and conditions. You must be at least 18 years of age to access or use this Site or accept this Agreement. Please note that these Terms contain an arbitration agreement that affects your legal rights. You and Pet Door USA agree that any disputes between us will be resolved through mandatory binding individual arbitration, and you waive any right to participate in a class-action lawsuit or class-wide arbitration, as well as the right to a jury trial. It is important to carefully review these Terms before accessing or using the Site.
Electronic Communications
When utilizing our website or transmitting electronic communications, such as emails, from your personal computer or mobile device, you are engaging in electronic communication with us. By transmitting such communications, you provide your consent to receive electronic responses from us in the same format. You may retain copies of these communications for your personal records. You acknowledge and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically fulfill any legal obligation that such communications be in writing.
Accounts
To utilize specific functionalities of the Site, such as purchasing Products, it is necessary to register for a Pet Door USA Account and provide the requested personal information through the Site registration form. It is hereby affirmed that all information submitted during registration is truthful and accurate, and that the accuracy of such information will be maintained. Furthermore, the use of the Site must not contravene any applicable laws or regulations, nor the terms of this Agreement. The confidentiality of the Pet Door USA Account login information is the sole responsibility of the user. All activities associated with the Pet Door USA Account, including purchases, use of the Site, or correspondence with Pet Door USA, are the full responsibility of the user. In the event of any unauthorized use or suspected breach of security, Pet Door USA must be immediately notified. Upon receipt of such notice, Pet Door USA will suspend or secure the Account to prevent any future unauthorized activity.
Permissible Uses of Site
In accordance with the provisions of this Agreement, Pet Door USA hereby grants you a limited, non-transferable, non-exclusive license to access and utilize the Site for personal purposes. It is important to note that this license does not extend to any commercial or resale use of the Site’s features or content, nor does it authorize access or use of the Site for any of the restricted purposes outlined below.
Pet Door USA retains the right to terminate this license at any time and for any reason. The rights granted to you under this Agreement are subject to certain restrictions, including but not limited to: (a) refraining from using the Site to place orders on behalf of yourself or a third party for the purpose of resale to that third party; (b) refraining from licensing, sublicensing, reproducing, selling, renting, leasing, transferring, assigning, distributing, hosting, or otherwise commercially exploiting the Site, its products, or its content without the express written consent of Pet Door USA; (c) refraining from modifying, creating derivative works of, disassembling, reverse compiling, or reverse engineering any part of the Site; (d) refraining from accessing the Site for the purpose of building a similar or competitive service, or for the purpose of downloading, copying, or collecting content or account information for the benefit of another merchant; (e) acknowledging that, except as expressly stated herein, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means without the express written consent of Pet Door USA; and (f) refraining from framing or utilizing framing techniques to enclose any trademark, logo, or other proprietary information or content (including images and text descriptions) of the Site without the express written consent of Pet Door USA. Pet Door USA reserves the right to modify, suspend, or discontinue the Site or any part thereof at any time and with or without notice.
By accessing and utilizing the Site, you agree that Pet Door USA will not be held liable to you or any third party for any modification, suspension, or discontinuance of the Site or any part thereof.
